Consumer Health Data Privacy

For residents of Washington State and Nevada

This notice is provided under the Washington My Health My Data Act (RCW 19.373) and Nevada SB 370. It is separate from our general Privacy Policy on purpose, because those laws ask for it separately.

The short version: we do not receive your health data at all. Kurbl runs on your device, and what it measures stays there.

Categories of consumer health data collected, and why

Kurbl processes, on your device only: heart rate, if you connect a device that measures it; power, cadence, speed, distance, and duration of a ride; energy expenditure calculated from your power; and body weight and reference power, if you enter them. It processes them for one purpose, which is to run the ride you started and show you what you did. None of it is transmitted to us.

Sources

The data comes from Bluetooth sensors you connect yourself and from figures you enter yourself. We are not a source and we are not a recipient.

Categories of consumer health data shared

None. We share no consumer health data, with anyone, for any purpose. We do not sell consumer health data. We have never sold consumer health data and we will not.

None.

One thing that is not sharing, but that you should know about anyway

If you turn on the health feature yourself, Kurbl writes the start and end time, the distance, and the calculated energy expenditure of a finished ride into your phone’s own health store: Apple Health on iOS, Health Connect on Android. That store belongs to you and lives on your device. Apple and Google are not receiving that data from us; your operating system is holding it for you. The feature is off until you switch it on and grant permission, and you can turn it off again at any time.

How to exercise your rights

Under RCW 19.373.040 you have the right to know whether we collect, share, or sell your consumer health data, to get a list of anyone we shared it with, to withdraw consent, and to have the data deleted. Since we hold none of your consumer health data, there is nothing on our side to disclose or delete. You can still make the request, and we will confirm that in writing.

Write to info@mlp3d.de with “Consumer health data request” in the subject line. We will respond within 45 days. If we need more time, we will tell you within those 45 days and take no more than 45 days more.

To delete the data on your own device, delete the rides in the app or uninstall it. To delete what was written to Apple Health or Health Connect, delete it there.

If you think we got this wrong, you can complain to the Washington State Attorney General’s Office.
